This website is operated by Nanoplants. Throughout the site, the terms “we”, “us” and “our” refer to Nanoplants. Nanoplants offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service, including any additional terms, conditions and policies referenced herein or available by hyperlink, including our Refund Policy and Privacy Policy.

These Terms of Service apply to all users of the site, including without limitation browsers, customers, merchants and contributors of content.

Please read these Terms of Service carefully before accessing or using our website. If you do not agree to all of the terms and conditions of this agreement, then you may not access the website or use any services.

1. Online Store Terms

By agreeing to these Terms of Service, you confirm that you are legally capable of entering into binding contracts under the laws applicable to you.

You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.

A breach or violation of any of the Terms may result in an immediate termination of your access to our services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

We reserve the right to limit quantities, cancel orders, or refuse orders where necessary, including where we suspect fraud, misuse of the website, stock errors, pricing errors, or where shipping the order would not be feasible.

You understand that your content (excluding payment information) may be transferred unencrypted and involve transmissions over various networks. Payment information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.

3. Products and Availability

Nanoplants sells live terrarium plants and may from time to time also offer related items, accessories, preorders, or limited-availability products.

All products are subject to availability. We reserve the right to discontinue any product at any time, to limit the quantities of any product or service that we offer, and to refuse or cancel orders where stock is unavailable or an error has occurred.

Because we sell live plants, each plant is unique. Variations in size, shape, colour, growth pattern, leaf condition and overall appearance are normal and expected. Product photos are for general representation only and the plant you receive may differ slightly from the photographed example.

Minor cosmetic imperfections, minor transit stress, or natural variation do not mean a plant is defective.

4. Pricing and Product Information

We make every effort to display our products and descriptions as accurately as possible. However, we do not guarantee that all product descriptions, pricing, availability information, or other content on the site will always be accurate, complete, current or error-free.

We reserve the right to correct any errors, inaccuracies or omissions at any time without prior notice, including after an order has been submitted.

Prices for our products are subject to change without notice.

5. Orders

By placing an order, you agree that all information provided is accurate and complete.

We reserve the right to refuse, cancel, or limit any order at our discretion. This may include orders that appear to be placed by dealers, resellers, or distributors, orders affected by pricing or stock errors, or orders that cannot be fulfilled for logistical or legal reasons.

If we cancel or change an order, we may attempt to notify you using the contact details provided at checkout.

6. Shipping and Delivery

Nanoplants is based in Poland and currently ships within the European Union. We reserve the right to change, suspend or limit our shipping destinations at any time, including temporarily or permanently stopping shipments to certain countries.

Shipping Schedule

We generally ship on Mondays only in order to reduce the risk of live plants being delayed in transit over weekends or public holidays.

If a public holiday in Poland, the destination country, or a relevant transit period could reasonably increase the risk of delay, we may postpone shipment to the next suitable shipping date. This includes situations where shipping shortly before a holiday could result in the parcel being held in transit for an extended period.

Shipping times provided at checkout or elsewhere on the site are estimates only and are not guaranteed.

Delays

We are not responsible for delays caused by couriers, customs, weather conditions, public holidays, strikes, transport disruptions, or other events outside our reasonable control.

Customer Responsibility for Delivery Details and Collection

Customers are responsible for providing a correct and complete shipping address and for collecting or accepting delivery of their parcel promptly.

Because our products are live and perishable, we are not responsible for deterioration, damage or loss caused by:

  • an incorrect address provided by the customer,
  • failure to collect the parcel promptly,
  • refusal of delivery,
  • missed delivery attempts,
  • or delays occurring after delivery has been attempted.

If a parcel is returned to us due to an incorrect address, failure to collect, refusal of delivery, or another issue caused by the customer, the order may not be eligible for a refund.

7. Local Pickup

Local pickup may be available for selected orders. If local pickup is selected, customers are responsible for collecting their order within the timeframe communicated by us.

We are not responsible for deterioration of live plants caused by delays in collection after the order is made available for pickup.

8. Heat Packs, Winter Shipping and Shipping Risk

During colder periods, we may include heat packs or take additional packaging measures to help protect live plants during transit. These measures reduce risk but do not guarantee that plants will arrive without stress or damage.

We reserve the right to delay, restrict or cancel shipping during periods of unsuitable weather or where we believe shipping conditions create an unreasonable risk to the health of the plants.

9. Preorders

From time to time, we may offer plants on a preorder basis. Estimated shipping dates for preorders are approximate only and may change depending on availability, supplier delays, import timing, plant condition, weather, or other circumstances outside our control.

If you place an order containing both preorder and in-stock items, we may hold the order until all items are available, unless otherwise stated.

10. Refunds and Complaints

Because we sell live plants, our Refund Policy applies to all issues relating to damaged, dead on arrival, or non-viable plants.

Customers must inspect live plants promptly upon delivery or collection.

If a plant arrives dead or heavily damaged, the customer must report this within the timeframe and with the evidence required under our Refund Policy.

Minor cosmetic damage, natural variation, and normal transit stress do not qualify for a refund where the plant remains alive and generally healthy overall.

Nothing in these Terms limits any rights you may have under applicable consumer protection law.

11. Optional Tools and Third-Party Services

We may provide you with access to third-party tools, apps, payment providers or services over which we neither monitor nor have any control.

You acknowledge and agree that we provide access to such tools and services “as is” and “as available” without any warranties, representations or conditions of any kind.

We shall have no liability arising from or relating to your use of optional third-party tools or services.

12. Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

You agree to promptly update your information, including your email address and shipping details, so that we can complete your transactions and contact you if needed.

13. Prohibited Uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content:

  • for any unlawful purpose,
  • to solicit others to perform unlawful acts,
  • to violate any international, national or local laws or regulations,
  • to infringe upon our intellectual property rights or the intellectual property rights of others,
  • to harass, abuse, insult, harm, defame, slander, intimidate or discriminate,
  • to submit false or misleading information,
  • to upload or transmit malicious code or viruses,
  • to collect or track the personal information of others,
  • to spam, phish, scrape, crawl or interfere with the security or operation of the Service.

We reserve the right to terminate your use of the Service for violating any prohibited uses.

14. Limitation of Liability

To the fullest extent permitted by law, Nanoplants shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the website or purchase of any product from us.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer rights.

15. Indemnification

You agree to indemnify, defend and hold harmless Nanoplants from any claim or demand arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

16. Severability

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

17. Termination

These Terms of Service are effective unless and until terminated by either you or us.

We may terminate or suspend your access to the Service at any time without notice if, in our sole judgment, you fail to comply with any term or provision of these Terms of Service.

18. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Poland, without prejudice to any mandatory consumer protection rights that may apply in the customer’s country of residence where required by law.

19. Changes to These Terms of Service

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and changes on our website. It is your responsibility to check this page periodically for changes.
